§ 11-26. Forfeiture of property bonds.

  • Property bonds may be forfeited by the judge of the municipal court if the defendant does not appear in court on the date cited, or the defendant does not pay the fine imposed, upon giving the surety on the bond seven (7) days' notice of a bond forfeiture hearing by certified mail at the address shown on the bond. Notice is complete upon mailing and the surety's appearance in municipal court after proper notice of the opportunity to be heard is not necessary for the municipal judge to enter a judgment of forfeiture of the bond against the surety.
