§ 12-63. Violations and penalties.

  • (a)

    It shall be unlawful for any person who owns, manages, operates or otherwise controls the use of any premises subject to regulation under this article to fail to comply with any of its provisions.

    (b)

    It shall be unlawful for any person to smoke in any area where smoking is prohibited by the provisions of this article.

    (c)

    Any person found guilty of violating any provision of this article in the Cordele Criminal Court shall receive a fine for the first offense of one hundred dollars ($100.00). Thereafter, for the second and subsequent convictions, such person shall be punished within the limits of punishment set forth in section 7.03 of the Charter of the City of Cordele (Ga.L.) 1969, pp. 3850, 3851), as the judge of said court may determine, but in no event less than one hundred dollars ($100.00).

    (d)

    Each day of continuing violation shall be deemed to be a separate violation.
