§ 15-11. Removal of obstacles.

  • (a)

    Obstructions placed upon the streets, alleys, or sidewalks of the city in violation of section 15-4 of this chapter may be summarily removed by the city police department if such prevents or materially interferes with the proper and legitimate use of the streets, alleys or sidewalks of the city.

    (b)

    Obstructions removed as aforesaid shall be temporarily stored on city property at a location designated by the city manager.

    (c)

    If the owner of such removed obstructions is known, he or she shall be issued a summons to appear at the municipal court of the city, and the judge of said court is hereby empowered to order the disposition of such obstructions by the owner. Failure of the owner to follow such order shall be unlawful and subject the owner to such punishment as the judge of said court may determine appropriate.

    (d)

    If the owner of such obstructions is not known, and cannot be determined upon a reasonable investigation by the police department, such obstructions shall be considered abandoned property and disposed of as the law provides.
