§ 3-137. Proximity restrictions.

  • (a)

    No person may sell or offer to sell:

    (1)

    a.

    Liquor by the drink in or within one hundred (100) yards of any church building or within two hundred (200) yards of any school building, educational building, school grounds, or college campus. This subsection shall not apply at any location for which a new license is applied for if the sale of liquor by the drink was lawful at such location at any time during the twelve (12) months immediately preceding such application, unless the location does not have adequate parking to accommodate the restaurant or private club. Adequacy of parking under this subsection shall be determined as required by the zoning ordinance of the City of Cordele.

    b.

    A church building in a business zoning district is defined as a free-standing structure built for and used as a church, and does not apply to commercial or retail space that has been converted to occupancy as a church.

    (2)

    Liquor by the drink within one hundred (100) yards of an alcoholic treatment center owned and operated by this state or any county or municipal government therein. This subsection shall not apply to any business having a license in effect within six (6) months after the final adoption of this article.

    (3)

    Nothing contained in this article shall prohibit the licensing of the sale or distribution of liquor by the drink by:

    (b)

    Bona fide private clubs, owning their own premises, subject to licensing under state law.

    (c)

    For the purposes of this article, distances shall be measured by drawing a straight line from the nearest point of the outside wall conditioned (mechanically heated or cooled) space of the applicant's business establishment to the nearest point of either (a) the outside wall enclosing conditional (mechanically heated or cooled) space of a church, school, or educational building, or (b) the real property of a school grounds or college campus.
